Background Regarding Shareowner Services Incident
In late February, 2008, one of ten boxes of back-up data storage tapes was discovered missing from a third-party archiving vendor responsible for transporting the tapes to an off-site storage facility from BNY Mellon Shareowner Services' facility in New Jersey. BNY Mellon Shareowner Services serves as a stock transfer agent and stock plan administrator for public companies. The tapes included shareholder and plan participant account information, such as name, mailing address, Social Security number, and transaction activity.
When BNY Mellon Shareowner Services learned that this box of data tapes could not be accounted for by the third-party archiving vendor in question, the Company:
- Cooperated with law enforcement agencies, who investigated the potential security breach.
- Notified the Office of the Comptroller of the Currency, the New York State Banking Department, the Federal Reserve Board, the Securities and Exchange Commission and various state authorities.
- Engaged an independent data firm along with independent legal counsel to assist in conducting an investigation into the circumstances of the loss and assessment of the data on the tapes.
- Terminated the courier services of the third-party vendor responsible for transporting these back-up tapes.
The company undertook an extensive notification process to notify impacted individuals to provide them with comprehensive fraud protection assistance though there continues to be no indication that the data has been accessed or misused in any way.
