Protecting the Confidentiality and Integrity of Our Clients' Information Is a Top Priority For BNY Mellon.

During the first half of 2008, we learned of two isolated incidents in which back-up data storage tapes were discovered missing from third-party couriers working for the Company's BNY Mellon Shareowner Services and BNY Mellon Treasury Services businesses. We take these incidents very seriously and sincerely apologize to all of those impacted.

Our inability to account for the whereabouts of these tapes resulted in an extensive notification process whereby we notified individuals whose personal information may have been included on the tapes.

• At the time of the incidents, we said there were no indications that the data had been accessed or misused in any way. That remains the case.

We are providing comprehensive fraud protection assistance to individuals whose personal information may have been included on these back-up data storage tapes. This includes two years of free credit monitoring, $25,000 worth of identity theft insurance ($10,000 in New York), reimbursement for the cost of one placement and one removal of a credit freeze for each of the three national credit reporting bureaus, and dedicated hotlines to respond to any consumer questions and assist with any concerns that these individuals might have.

We also have initiated a thorough, top-to-bottom review of our existing security policies and procedures to ensure the Company has industry-leading security measures in place across all of our businesses. And, we have taken several new steps to continue enhancing our security measures and minimize such threats in the future.
